Where a separate written agreement exists, the terms of that agreement may prevail over these general Terms & Conditions in relation to the specific project.

    2. Portfolio, Client Logos and Brand References

Our website, presentations, proposals, social media content, case studies, demonstrations, and marketing materials may display the names, logos, trademarks, trade names, products, packaging, websites, visual identities, or other brand-related material belonging to third parties.

Unless explicitly stated otherwise, such references are displayed for one or more of the following purposes:

        • Illustrative reference

        • Portfolio presentation

        • Demonstration of industry experience

        • Creative inspiration

        • Conceptual presentation

        • Design experimentation

        • Educational or informational purposes

        • Contextual representation of markets, industries, or audiences

The presence of a third-party logo, name, trademark, product, or other identifying material on our website or creative materials does not automatically imply that Aurelis currently represents, is officially affiliated with, endorsed by, sponsored by, authorised by, partnered with, or employed by the respective brand or organisation.

All third-party trademarks, logos, brand names, and intellectual property remain the property of their respective owners.

Any use of such material is intended solely for identification, reference, commentary, illustration, portfolio context, or conceptual presentation where applicable.

If you are a trademark owner or authorised representative and believe that any reference displayed by Aurelis is inaccurate, inappropriate, or requires modification or removal, you may contact us with relevant details and supporting information. We will review reasonable requests in good faith.

      3. Conceptual Artwork, Fan Art and Speculative Creative Work

Aurelis may create and display conceptual designs, speculative advertisements, mock campaigns, redesigns, visual experiments, packaging concepts, social media creatives, website concepts, product visualisations, or other artistic and creative work featuring recognisable brands, products, public figures, fictional properties, or cultural references.

Unless expressly identified as official commissioned work, such material should be understood as:

Unofficial conceptual artwork, creative exploration, speculative design, fan art, demonstration work, or independent artistic interpretation.

These concepts are created to demonstrate creative capabilities, design thinking, visual experimentation, storytelling, advertising concepts, artistic direction, or hypothetical applications of creative services.

      They are not necessarily:

          • Official advertisements

          • Official campaigns

          • Brand-approved communications

          • Commercial releases

          • Endorsed content

          • Sponsored collaborations

          • Authorised redesigns

          • Products available for purchase

          • Representations of an existing commercial relationship

Aurelis does not claim ownership of third-party trademarks, characters, logos, brand identities, product names, or other intellectual property that may appear within conceptual work.

Where third-party intellectual property is referenced within conceptual artwork, ownership of the underlying intellectual property remains with its respective owner.

The original creative execution, composition, design treatment, artistic direction, and other independently created elements may remain subject to Aurelis’ intellectual property rights.

        4. No Claim of Affiliation or Endorsement

Unless explicitly stated in writing, nothing on our website should be interpreted as establishing an official relationship between Aurelis and any third-party company, brand, organisation, personality, product, platform, or intellectual property owner.

References to third parties do not necessarily indicate:

            • Partnership

            • Sponsorship

            • Endorsement

            • Employment

            • Representation

            • Certification

            • Authorisation

            • Approval

            • Collaboration

Likewise, the inclusion of Aurelis’ name, work, or content alongside a third-party reference should not be interpreted as an endorsement of Aurelis by that third party.

          5. Accuracy of Portfolio and Case Study Information

We make reasonable efforts to present our work, capabilities, experience, and creative output accurately.

However, portfolio projects, demonstrations, case studies, testimonials, visualisations, statistics, concepts, prototypes, and campaign examples may be simplified, anonymised, modified, recreated, conceptualised, updated, or presented differently from their original form for communication and portfolio purposes.

          Certain examples may represent:

              • Early-stage concepts

              • Alternative design directions

              • Unreleased creative work

              • Experimental projects

              • Internal demonstrations

              • Mockups

              • Prototype experiences

              • Illustrative scenarios

              • Sample campaigns

Results, outcomes, performance metrics, and examples shown in connection with marketing services should not be interpreted as guarantees of identical results for future clients.

Marketing and business performance depends on numerous variables, including market conditions, budgets, competition, customer behaviour, product quality, pricing, timing, platform policies, and factors outside Aurelis’ control.

            6. No Guarantee of Specific Results

Aurelis may provide strategy, creative services, marketing services, consulting, technology solutions, and recommendations designed to support a client’s objectives.

However, unless expressly guaranteed in a separately signed written agreement, Aurelis does not guarantee:

                • Specific revenue figures

                • Specific sales volumes

                • Specific numbers of leads

                • Search engine rankings

                • Social media growth

                • Advertising performance

                • Website traffic

                • Conversion rates

                • Profitability

                • Business growth

                • Media coverage

                • Viral reach

Past performance, case studies, examples, or results achieved in previous projects should not be considered a promise or guarantee of future performance.

              7. Client Responsibilities

Clients engaging Aurelis are responsible for providing accurate, complete, and timely information required for the performance of services.

Clients are also responsible for ensuring that materials supplied to Aurelis, including but not limited to logos, images, videos, copy, trademarks, product information, customer data, and intellectual property, may legally be used for the intended purpose.

By providing materials to Aurelis, the client represents that they have the necessary rights, permissions, licences, or authority to permit Aurelis to use those materials in connection with the agreed services.

Aurelis shall not be responsible for legal claims arising from inaccurate, unlawful, infringing, misleading, or unauthorised materials supplied by a client.

              8. Intellectual Property and Ownership

Unless otherwise agreed in writing, all pre-existing intellectual property, methodologies, frameworks, processes, templates, systems, tools, code libraries, creative techniques, strategies, and proprietary materials developed or owned by Aurelis shall remain the property of Aurelis.

Project-specific deliverables may be transferred, licensed, or made available to a client according to the terms agreed for that project.

The scope of ownership or usage rights may depend on factors including:

                  • Completion of payment

                  • Project scope

                  • Third-party licensing restrictions

                  • Stock asset licences

                  • Music

                  • Photography

                  • Video assets

                  • AI-generated elements

                  • Platform restrictions

A client may not automatically acquire ownership of working files, source files, editable files, development frameworks, internal documentation, unused concepts, rejected designs, or proprietary systems unless expressly agreed in writing.

                9. Third-Party Assets and Services

Creative and technical work may incorporate third-party tools, platforms, software, plugins, fonts, stock assets, APIs, hosting providers, advertising platforms, analytics services, payment gateways, AI tools, or other external services.

The availability, performance, security, pricing, policies, and functionality of third-party services are outside Aurelis’ direct control.

Aurelis shall not be responsible for losses, interruptions, policy changes, account suspensions, data loss, feature changes, outages, or other issues caused by third-party platforms or providers.

Clients may be required to maintain their own subscriptions, accounts, licences, domains, advertising accounts, hosting accounts, or third-party service agreements.

                10. Website and Digital Services

Where Aurelis provides website design, development, hosting, maintenance, infrastructure, or related digital services, reasonable efforts will be made to maintain reliable and professional service.

However, no website, server, platform, or digital system can be guaranteed to be entirely free from interruptions, vulnerabilities, technical errors, security incidents, or external failures.

Aurelis shall not be responsible for issues caused by:

                    • Internet outages

                    • Third-party hosting providers

                    • Domain providers

                    • Client modifications

                    • Unauthorised access

                    • Third-party integrations

Where hosting or infrastructure is managed by Aurelis, the scope of support, maintenance, backups, uptime expectations, and responsibilities may be separately defined within the applicable service agreement.

                  11. Creative Subjectivity and Revisions

                  Creative services are inherently subjective.

Aurelis will make reasonable efforts to understand the client’s objectives and provide work aligned with the agreed brief. However, personal preferences regarding design, style, messaging, colour, creative direction, or aesthetics may differ between individuals.

The number and scope of revisions included in a project will be determined by the relevant proposal, quotation, or agreement.

Additional revisions, changes in direction, new requirements, or work requested outside the agreed scope may require additional time and fees.

                  12. Confidentiality

Both Aurelis and its clients should treat confidential information shared during a professional engagement with reasonable care.

However, Aurelis may retain the right to disclose information where required by law or necessary to protect its legal rights.

Unless otherwise agreed in writing, Aurelis may also retain the right to reference completed work in its portfolio, website, social media, presentations, and promotional materials, provided such disclosure does not violate a specific confidentiality agreement.

Clients requiring strict confidentiality, non-disclosure, or restrictions on portfolio usage should communicate such requirements before the commencement of the project.

                  13. Payments and Commercial Terms

Payment schedules, fees, deposits, recurring charges, taxes, and other commercial terms will generally be communicated through proposals, quotations, invoices, or separate agreements.

                  Unless otherwise agreed:

                      • Work may commence only after receipt of the required advance payment.

                      • Delays in payment may result in delays to project timelines.

                      • Aurelis may suspend services for significantly overdue payments.

                      • Completed deliverables may remain subject to payment conditions before ownership or usage rights are transferred.

                      • Applicable taxes may be charged where required.

Payments for completed work, time already spent, third-party services, licences, advertising spend, or committed resources may not necessarily be refundable.

                    14. Advertising and Marketing Platforms

Advertising and digital marketing platforms operate independently and maintain their own rules, algorithms, policies, pricing, and approval processes.

                    Aurelis cannot guarantee that:

                        • Advertisements will be approved

                        • Accounts will remain active

                        • Platform features will remain unchanged

                        • Specific targeting options will remain available

                        • Costs will remain stable

                        • Campaign performance will remain consistent

Clients are responsible for ensuring that their products, services, claims, landing pages, and business activities comply with applicable laws and platform policies.

Aurelis may decline to create or publish advertising content that it reasonably believes may violate applicable laws, platform rules, intellectual property rights, or ethical standards.

                      15. AI-Assisted Content

Aurelis may use artificial intelligence or AI-assisted tools as part of its creative, research, development, productivity, automation, or production processes.

AI-generated or AI-assisted material may require human review and may occasionally contain inaccuracies, inconsistencies, unexpected outputs, or similarities to existing material.

Clients should independently review important factual, legal, regulatory, medical, financial, technical, or commercial claims before publication or implementation.

Where AI tools are used, Aurelis does not guarantee that all generated material will be unique, copyrightable, registrable, or free from potential third-party claims.

                      16. Limitation of Liability

To the maximum extent permitted by applicable law, Aurelis shall not be liable for indirect, incidental, consequential, special, punitive, or business-related losses arising from the use of our website, services, content, recommendations, or deliverables.

This may include, but is not limited to, loss of:

                          • Revenue

                          • Profits

                          • Data

                          • Business opportunities

                          • Reputation

                          • Customers

                          • Advertising accounts

                          • Search rankings

                          • Digital assets

Where liability cannot legally be excluded, Aurelis’ liability shall be limited to the maximum extent permitted by applicable law and, where appropriate, to the amount paid to Aurelis for the specific service giving rise to the claim.

                        17. Indemnification

Clients agree to indemnify and hold Aurelis, its employees, contractors, partners, and representatives harmless against claims, losses, damages, liabilities, and reasonable expenses arising from:

                            • Client-provided content

                            • Unauthorised use of third-party intellectual property

                            • Products or services sold by the client

                            • Client instructions that result in legal or regulatory issues

This section applies to the extent permitted under applicable law.

                          18. Website Content Disclaimer

Important Disclaimer Regarding Third-Party Brands and Conceptual Work

Any third-party brands, logos, trademarks, products, packaging, characters, names, visual identities, or intellectual property displayed within our portfolio, creative experiments, social media content, presentations, or website are used for identification, reference, illustrative, conceptual, artistic, commentary, demonstration, or portfolio purposes where applicable.

Unless expressly stated otherwise, conceptual advertisements, speculative campaigns, redesigns, mockups, visual experiments, and fan art created by Aurelis are unofficial and independently produced creative concepts. They are not sponsored, endorsed, approved, commissioned, or authorised by the respective trademark or intellectual property owners.

All third-party intellectual property remains the property of its respective owners. Aurelis does not claim ownership of such underlying trademarks or intellectual property solely because they appear within conceptual or illustrative work.

The inclusion of any third-party brand or logo does not automatically imply an existing commercial relationship, partnership, affiliation, endorsement, sponsorship, or representation.

By accessing this website, you acknowledge that creative concepts and portfolio references should be interpreted within their appropriate contextual and illustrative purpose.
